Automobiles, Recalls & Litigation of Defective Products

This is an updated  post that now combines a the best news coverage with sub par legal analysis.  I am joking, of course.  Call me if you need an Atlanta Accident Attorney.  The topic of this article is recalled products and injuries that follow because of them.  It is important to know that you have additional legal rights when a product that is used correctly goes wrong.  The reason is the insurance provider.  Think about this.  If you are hurt in a car accident, then you can sue or negotiate the claim with the insurance company for that driver.  On the other hand, if you are hurt because of a defective product, then the insurance policy limits will be so much different, it is not even in the same league.  Think about this for a second.  Who has more insurance coverage, you with your car in your garage or Honda or Chrysler or Toyota?  They have to have some much insurance, that it would be an almost impossibility they could ever run out of insurance coverage.  Not to say the value of a life is not important, no jury could ever issue a verdict that would withstand an appeal that could put an automobile company out of business.  If this happens, call your Atlanta wrongful death attorney, that is me, and I will retire.  So, let us go back in time and get back to the old post.  I will follow it up with more current analysis for you lovers of analysis.
This post is by the McDonough, Georgia Personal Injury Lawyer.Chrysler says that this summer they will fix airbags in certain minivans.  Chrysler stresses that the airbags meet safety standards and will be safe in a car accident.  With all of the recalls lately, such as Honda and Toyota, Chrysler says it is not a recall.  Let's hope they are rights that the airbags will continue to work in an automobile accident.  Here, in Georgia, especially in the suburbs, we have a lot of minivans.  I hope they are all safe.  I will write more about airbag injuries in later posts, so stay tuned for more.  Quick car airbag fact:  Airbags became mandatory in automobiles in the 1990′s.
I rememeber speaking to an attorney friend of mine about 10 years ago about a products liability case involving a car's airbag.  I thought it was a decent case, but not a great case.  I remember my friend describing what he called a traveling dog and pony show.  He indicated that the car company hired all of theses experts that were good and looked the part.  He said the engineer looked just like an engineer.  The scientist just like a scientist.  He said it was like Hollywood had put it together.  And, in a way they did because they traveled city to city and trial to trial saying and doing the exact same thing.  My friend indicated that this was a set up and be very cautious about the quality of the case you bring.  This is the case in all personal injury cases, but with larger ones you must be cautious.  As an Atlanta personal injury lawyer, it is important to protect your firm and your client from getting ambushed in court.  This would not be considered an accident.
